Terms of Use – CalOrange

These Terms of Use (“Terms”) govern your access to and use of the mobile applications and related services (collectively, the “Platform”) provided by TCC & Partners Joint Stock Company, with its registered office at No. 31, Alley 31, Luong Ngoc Quyen Street, Thanh Liet Ward, Hanoi City, Vietnam (“we”, “us”, or “our”).

By downloading, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Platform.

1. Eligibility

The Platform is intended for users of all ages. However, if you are under the age of 13, you may use the Platform only with the consent and supervision of a parent or legal guardian, in accordance with applicable laws and platform policies.

By using the Platform, you represent that you have the legal capacity to enter into these Terms.

2. License to Use the Platform

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, distribute, sublicense, lease, or sell the Platform.

• Reverse engineer, decompile, or attempt to extract the source code of the Platform.

• Use the Platform for unlawful, fraudulent, abusive, or unauthorized purposes.

• Interfere with the security or operation of the Platform.

3. Device Permissions

To provide its core functionalities, the Platform may request access to certain features on your iOS device.

Camera Access

The Platform uses your camera to capture meal photos for AI food recognition and nutrition analysis.

Photos Access

The Platform may access photos selected by you to analyze meals, create food logs, and store your meal history.

Notifications

The Platform may send reminders for meals, calorie goals, nutrition tracking, streaks, and other Platform-related notifications.

Tracking Permission

Where applicable, the Platform may request permission under Apple’s App Tracking Transparency (ATT) framework before accessing advertising identifiers.

You may revoke these permissions at any time through your iOS Settings. Certain Platform features may not function properly if required permissions are disabled.

4. AI Nutrition Services

The Platform provides AI-powered features including:

• AI food recognition

• Barcode food scanning

• Manual meal logging

• Food search

• Voice meal logging

• Nutrition estimation

• Calorie tracking

• Macro calculations

• Weight tracking

• Daily nutrition reports

• AI Chat Coach

• Personalized nutrition recommendations

The Platform is designed to assist users in tracking nutrition and eating habits.

Nutrition values, calorie estimates, AI-generated recommendations, and food recognition results are generated automatically based on available information and may not always be accurate or complete.

5. Health Disclaimer

The Platform is intended solely for personal wellness, educational, and informational purposes.

The Platform is not a medical device and does not provide medical advice, diagnosis, treatment, or professional nutritional consultation.

Calorie targets, BMI calculations, macro recommendations, nutrition analyses, AI-generated suggestions, and other health-related information should not replace advice from qualified healthcare professionals.

You remain solely responsible for your dietary, fitness, and healthcare decisions.

6. Services, Subscriptions, and In-App Purchases

The Platform may offer paid features, subscriptions, premium AI services, advanced analytics, personalized reports, and other in-app purchases.

All payments are processed exclusively through the Apple App Store.

We do not collect or store payment card information.

Subscription pricing, billing cycles, renewals, cancellations, and refunds are governed by Apple’s App Store policies.

You are responsible for managing your subscriptions through your Apple ID account.

7. Intellectual Property

All software, graphics, user interfaces, mascots, AI models, databases, trademarks, logos, and other intellectual property related to the Platform are owned by or licensed to TCC & Partners Joint Stock Company.

Nothing contained in these Terms grants you ownership of any part of the Platform or its content.

8. User Content and Feedback

User Content includes, but is not limited to:

• Meal logs

• Food photographs

• Voice recordings submitted for meal logging

• Weight history

• Nutrition records

• AI Chat conversations

• Notes

• Mood tags

• Other content uploaded or created through the Platform

You retain ownership of your User Content.

You are solely responsible for ensuring that your User Content does not violate applicable laws or infringe the rights of third parties.

If you submit suggestions, feature requests, or feedback, you grant us a non-exclusive, royalty-free, worldwide license to use such feedback for operating, maintaining, and improving the Platform.

We are not obligated to publish, retain, or respond to any user-submitted content.

9. Advertising and Third-Party Services

The Platform may display advertisements or integrate services provided by third parties, including but not limited to:

• Apple

• Google

• Firebase

• Meta

• TikTok

• AI service providers

• Nutrition databases

• Barcode databases

• Analytics providers

We are not responsible for the availability, content, accuracy, or practices of third-party services.

Your interactions with third-party services are governed by their respective terms and privacy policies.

10. Availability and Modifications

We may modify, suspend, or discontinue any part of the Platform at any time, temporarily or permanently, with or without notice.

We do not guarantee that the Platform will always be available, uninterrupted, secure, or error-free.

11. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or reliability.

We do not guarantee:

• AI food recognition accuracy.

• Barcode recognition accuracy.

• Nutrition database completeness.

• Calorie estimation accuracy.

• Macro calculation accuracy.

• AI Chat Coach responses.

• Personalized nutrition recommendations.

• Continuous availability of AI-powered services.

12. Limitation of Liability

To the maximum extent permitted by law, TCC & Partners Joint Stock Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Platform.

This includes, without limitation:

• Inaccurate calorie estimates.

• Incorrect nutrition information.

• AI-generated recommendations.

• Food recognition errors.

• Meal logging errors.

• Health-related decisions made by users.

• Data loss.

• Service interruptions.

• Subscription issues caused by third-party providers.

Our total liability, if any, shall not exceed the amount paid by you for use of the Platform during the twelve (12) months preceding the relevant claim.

13. Termination

We may suspend or terminate your access to the Platform at any time if you violate these Terms, misuse the Platform, or where required by applicable law.

Upon termination, your right to use the Platform immediately ceases.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time.

Any updated version will be published within the Platform or through other appropriate channels.

Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
